"A licensee shall not impose an annual percentage rate greater than thirty-six percent in connection with a delayed deposit transaction." This 36% APR cap was enacted by ballot Initiative 428 (approved November 2020), amending the Delayed Deposit Services Licensing Act, effectively ending traditional high-fee payday lending in the state while leaving the licensing framework itself in place.
Fees
All charges must be included within the 36% APR cap; a transaction violating the cap is void and the licensee forfeits all principal, interest, and fees. Separate military fee limits apply per 10 U.S.C. 987 for active-duty members, spouses, and dependents.
