Rate, fee and license rules in West Virginia
Installment and personal loans
- Rate cap
- Regulated Consumer Lenders, W. Va. Code sec. 46A-4-107: 31 percent per year on the unpaid balance for unsecured loans of 3,500 dollars or less; 27 percent per year on the unpaid balance for loans greater than 3,500 dollars but not more than 15,000 dollars, or secured by real property; 18 percent per year on the unpaid balance for loans over 15,000 dollars. Alternative for unsecured loans of 3,500 dollars or less: up to 31 percent per year plus a nonrefundable processing fee of not more than 2 percent of the amount financed.
- Fees
- Non-real-estate secured loans over 3,500 dollars: up to 2 percent origination/points/investigation fee. Real-estate-secured loans: up to 5 percent origination/points/investigation fee, not re-imposable within 24 months on a refinance unless earlier charges are rebated or combined charges stay within 5 percent. Revolving accounts: monthly charge of 1/12 of the annual rate on the average daily balance or opening balance minus payments.
- License
- Regulated Consumer Lender license under W. Va. Code chapter 46A, article 4, issued by the West Virginia Division of Financial Institutions.
Title loans
- Rate cap
- Not applicable; auto title loans are reported as prohibited in West Virginia.
- Fees
- Not applicable.
Payday loans
- Rate cap
- No stand-alone payday/deferred-presentment license exists; a small short-term loan is subject to the same Regulated Consumer Lender tiered caps under sec. 46A-4-107 (31 percent per year for balances of 3,500 dollars or less), which is far below rates that payday lenders typically charge, so triple-digit-APR payday lending is not commercially viable and no licensed payday storefronts operate in the state.
- Fees
- Same as installment: 2 percent processing-fee alternative for loans of 3,500 dollars or less; no separate payday fee schedule exists.
- License
- None specific to payday lending; any short-term cash loan would have to be made under a Regulated Consumer Lender license (W. Va. Code chapter 46A, article 4) and comply with the same rate caps.
