Payday loans
- Rate cap
- No general statutory APR cap for deferred deposit loans or high-interest loans under NRS 604A; APR is set by contract. NRS 604A regulates term length, extensions, collection limits, and (since AB 118, 2023) requires an ability-to-repay analysis so payments generally cannot exceed 25% of the borrower's gross monthly income. Original term of a high-interest/deferred-deposit loan must not exceed 35 days (up to 90 days if fully amortizing installment structure with no balloon payment and no extensions).
- Fees
- Fee limitations exist in NRS 604A.5031, 604A.5061, and 604A.5094; no proceeds of a new high-interest/deferred-deposit loan may be used to pay off an outstanding high-interest loan except under specified conditions (NRS 604A.5057).
- License
- Deferred Deposit Loan / High-Interest Loan license under NRS Chapter 604A, issued by the Nevada Financial Institutions Division (FID).
